  4. A-1 Aluminum Siding, referred to as BIDDER, of Denver, Colorado,
  5. and American Fidelity & Guarantee, referred to as  SURETY, of
  6. Denver, Colorado, are bound to Yolanda Zmeck, of Denver, Colorado,
  7. referred to as  OBLIGEE, in the sum of $10000, (ten thousand
  8. Dollars), referred to as the  penal sum for the payment of this
  9. sum we bind ourselves and our  legal successors.

  11. If OBLIGEE accepts the bid of BIDDER, and BIDDER enters into a 
  12. contract with OBLIGEE in accordance with the invitation to bid, 
  13. and further, give such performance bonds as may be required, then 
  14. this obligation shall be void, otherwise the same shall remain in 
  15. full force and effect. Provided, however, that upon the failure 
  16. of the BIDDER to enter into the contract as described above, the 
  17. BIDDER shall pay either the difference between the bid submitted 
  18. by BIDDER and any larger amount which OBLIGEE may in good faith 
  19. contract to perform the work, or the penal sum, whichever is 
  20. lesser.
